By using Sidekick Mark, you agree to these terms of service. Please read them carefully.

Definitions

In these terms, the following definitions apply:

  • "Sidekick Mark", "we", "us": Sidekick Mark B.V.
  • "Service": the Sidekick Mark platform and all associated functionality
  • "User", "you", "your": the person or organization using the Service
  • "Account": your personal access to the Service
  • "Content": all text, images, and other materials generated or processed

Use of the Service

By using Sidekick Mark, you agree to the following:

  • You use the Service only for legitimate business purposes
  • You provide accurate and complete information during registration
  • You are responsible for all activities under your account
  • You do not share your login credentials with others
  • You respect the intellectual property rights of others

Account rules

The following rules apply to your account:

  • You must be at least 18 years old to create an account
  • One account per person or organization (unless otherwise agreed)
  • You are responsible for securing your password
  • You report suspicious activity to us immediately
  • We may suspend accounts that violate these terms

Payment and billing

For paid subscriptions, the following applies:

  • Prices are exclusive of VAT unless otherwise stated
  • Payments are billed in advance (monthly or yearly)
  • You authorize us to automatically charge via the provided payment method
  • We may suspend access to the Service for non-payment
  • Price changes will be announced 30 days in advance

Refunds

Our refund policy:

  • 14-day cooling-off period for new subscriptions (consumers)
  • Pro-rata refund for cancellation within the first month for business customers
  • No refund for partially used periods after the first month
  • Full refund if we terminate the Service

Liability

Regarding liability, the following applies:

  • We provide the Service "as is" without guarantees of results
  • We are not liable for indirect damages or lost profits
  • Our total liability is limited to the amount you paid in the past 12 months
  • We are not liable for damages caused by force majeure, third-party failures, or user misuse
  • You indemnify us against third-party claims arising from your use of the Service

Termination

About termination of the agreement:

  • You can cancel your subscription at any time via your account settings
  • After cancellation, you retain access until the end of the paid period
  • We may suspend or terminate your account for violating these terms
  • Upon termination, you have 30 days to export your data
  • After termination, we delete your data according to our privacy policy

Changes

About changes to these terms:

  • We may modify these terms from time to time
  • Material changes will be announced 30 days in advance via email
  • Continued use after changes means acceptance of the new terms
  • The most recent version is always available on our website

Disputes

In case of disputes:

  • Dutch law applies to these terms
  • Disputes will be submitted to the competent court in Amsterdam
  • We try to resolve disputes through mutual consultation first
